The purchaser understands and recognizes that racing parts, specialized street rod equipment, and all parts and services sold by Todds Performance LLC. are exposed to many and varied conditions due to the manner in which they are installed and used. Todds Performance LLC makes no warranties, either express or implied, including any warranty of merchantability with respect to the goods identified on the face of the invoice. There is no warranty expressed or implied as to whether the goods sold hereby will protect purchaser or ultimate user of such goods from injury or death. Todds Performance LLC assumes no liability after this time of sale.
Todds Performance LLC sells products made by various companys that have no warranties, express or implied and the purchaser and/or user, makes the sole determination of the suitability for use in the application of his or her own design. Racing is a dangerous activity that can result in injury or death and the buyer assumes all risks. By the installation or use of these components, the user or installer assumes all risks of damage ,injury or death. Some environments may subject components to severe stress and because components are subjected to many forces beyond there stress factors and time limits Todds Performance LLC or its suppliers will not be liable. If you do not want to assume these risks than you can return product, products before using and opening package for a full refund.
Purchaser hereby agrees to indemnify Todds Performance LLC and hold harmless Todds Performance LLC from and against any and all claims, liability, loss and damages, including attorney fees, made by any third party against Todds Performance LLC relating to a part or the use of any part.
